1 THE COMPETITION
1.1 The cultural contest “Endless OS Wallpaper Contest”, hereinafter referred to simply as “COMPETITION”, is exclusively recreational and cultural in nature, in accordance with the provisions of article 3, section II of Law 5.768 / 71 and art. 30 of Decree 70.951 / 72. The participation in this COMPETITION is voluntary and free of charge and is not require to the acquisition of any service or objet . Participation in this COMPETITION does not imply any encumbrance, of any nature for the participants and the winners who will be awarded at the end of the COMPETITION.
2 ORGANIZER
2.1 This COMPETITION is organized by ENDLESS INC,established in 575 Market St, St 825 - San Francisco - CA - USA, hereinafter referred to as “ORGANIZER”.
3 PARTICIPANTS
3.1 Individuals residing and domiciled in Indonesia, with a minimum of 18 (eighteen) years of age, may participate in this COMPETITION, excluding the directors of the ORGANIZER and their economic-financial conglomerate, directors, officers and employees. In addition to these, any person or organization employee who is, directly or indirectly, involved in any aspect of this COMPETITION may not participate in this COMPETITION.
4 HOW THE COMPETITION WORKS
4.1 This Contest will award five (5) participants, being: the five (5) creators of the best image for each of the five (5) themes, as votes by a panel of judges.
5 TERM OF PARTICIPATION
5.1 The participation period begins on January 15, 2018, at 10 AM and ends on February 25, 2018 at 11:59 PM, Jakarta time.
5.2 Only participations made according to the method described in this Regulation (Sections 7 and 8) and during the period of participation specified in this clause will be accepted.
5.3 All information provided by the participants to the ORGANIZER at the time of their participation shall be used in accordance with the provisions of this Regulation.
5.4 All participants made after the date and time provided in clause 5.1 will be excluded.
6 PARTICIPATION
6.1 Those interested in participating in this COMPETITION must:
a) Create an image (photograph or artwork) with the following attributes:
I) Have a minimum resolution of 1920 x 1080 pixels
II) Formatted as either a PNG or JPEG file
III) Provided under the CC-BY-SA CC-BY-ND, CC-BY license or Public Domain (CC0)
b) Upload it to the Flickr group https://www.flickr.com/groups/3889031@N25/ with your name and image title
c) Read this Regulation and accept the conditions of the COMPETITION, declaring and guaranteeing legal capacity to do so, and that all information provided by reason of their participation are true.
7 GENERAL TERMS AND CONDITIONS OF REGISTRATION
7.1 The PARTICIPANT may participate in the COMPETITION as many times as desired during the participation period, but will compete with only one (1) image.
7.2 The Images can not contain words or imagery that incite violence, contrary to morality and good manners, profanity or offenses to the name or morals of any person. There is no obligation of the ORGANIZER to communicate or inform the disqualified participants of their withdrawal from the CONTEST.
7.3 Likewise, images that make dishonorable references to persons, places, cultural works or any other protected by copyright or industrial or intellectual property rights, or videos that refer to any marks of the ORGANIZER or its competitors.
7.4 The ORGANIZER reserves the right to declassify registrations that do not meet the requirements set forth in this Clause 7 and in any other provision of this Regulation, regardless of any obligation to notify participants of this disqualification.
8 SELECTION AND NOTIFICATION OF WINNERS
8.1 The submitted images will be judged under the criteria of visual appeal, compatibility with the Endless Shell (application grid, panel, etc) and representation to the theme, in addition to the adequacy to the present Regulation, and will be evaluated in accordance with the following:
a) All images posted in public mode must be sent by February 25, 2018, will be analyzed by a JUDGING COMMITTEE composed of 6 (six) jurors selected by the ORGANIZER;
b) The five (5) best images will be awarded according to the proposed themes judged by the JUDGING COMMISSION.
c) The decisions of the ORGANIZER regarding the administration of this COMPETITION and selection of the winning participant are final and unappealable;
d) The names of the winners of this COMPETITION will be announced and will be available March 19, 2018.
e) Winning participants will be notified by email.
f) If one of the winning participants does not respond correctly to the email, within 7 days with the information requested to withdraw the prize, the prize will be disqualified, and the subsequent participant will be rewarded, according to the ranking of positions defined by the JUDGING COMMISSION, provided that the requirements contained in this regulation are fulfilled. In this case, the subsequent contemplated will be communicated and must submit to the same rules of this Regulation.
g) The ORGANIZER undertakes to do everything possible to contact the winning participant. However, the person who does not respond to the contact made by the ORGANIZER within 7 days will decline from the right to the prize.
8.2 In case of fraud calculated after disclosure of the result, the winning PARTICIPANT (s) will be automatically excluded from the COMPETITION, and the prize will be transferred to the next ranked participant to be chosen according to item 8.1 , “A”, provided that all valid conditions in this Regulation are met.
9 AWARD AND DELIVERY
9.1 Prize of the 5 (five) best images (one for each theme):
a) 1,000,000 IDR
b) Inclusion in the default Indonesian install images for Endless OS 3.4 if deemed appropriate by the ORGANIZER. The ORGANIZER retains right to exclude images from the default image as their sole discretion, this decision is final and unappealable
9.2 The winning entrant, upon receiving the prize of the CONTEST, agrees to sign a receipt and accept it without the right to future claims to the ORGANIZER, as well as agree to exempt the same and / or any company involved in the COMPETITION, its related companies , subsidiaries and affiliates, including their respective employees, representatives, service providers and agents or any other person or organization directly or indirectly involved in this CONTEST, from any and all lawsuits or legal actions consequent upon their participation in the CONTEST or receipt and use of any award, except for those relating to the compliance, smooth progress and outcome of the CONTEST.
10 GENERAL PROVISIONS
10.1 All participants of this Contest declare, from now on, their own authorship of the images sent to the ORGANIZER and that these do not constitute plagiarism of any kind, at the same time that they grant to the ORGANIZER, without any burden for this, and in character fully, totally and totally, the right of use, publication, reproduction by any means or technique for an indefinite period, under the terms of the Creative Commons CC-BY-SA CC-BY-ND, CC-BY license or Public Domain (CC0)
10.2 The authorizations described above do not imply any obligation of disclosure or payment of any amount by the ORGANIZER.
10.3 Any doubts, differences or situations not provided for in this Regulation shall be evaluated and decided by a Judging Committee of the ORGANIZER.
10.4 In case of proven fraud, the participant will be automatically excluded from the Contest, regardless of the sending of any notification and, if it is the winner, the prize will be transferred to the next entrant classified under the conditions valid and provided for in this regulation. For the purpose of this clause, it is considered a fraud involving participation with incorrect or false information, the participation of employees, third parties, relatives to second degree employees and third parties, promoters, agents, affiliates or others who have a direct or indirect professional relationship with the ORGANIZER.
10.5 The simple participation in this COMPETITION, by sending the image to the link (https://www.flickr.com/groups/3889031@N25/), implies in the knowledge and total acceptance of this Regulation.
10.6 A participant whose conduct entails the willful manipulation of the COMPETITION operation or who violates the terms and conditions imposed by these Regulations shall be automatically disqualified and / or disqualified.
10.7 If for any reason, other than at will and control of the ORGANIZER, it is not possible to conduct this COMPETITION according to plan, the ORGANIZER may finalize it in advance, upon notice to the participants. If the COMPETITION expires in advance, the ORGANIZER shall notify the public and the participants through the same means used for its disclosure, explaining the reasons that led to such decision.

10.9 This Contest, as well as its regulations, may be amended, at the discretion of the ORGANIZER, upon notice in the Endless fan page https://www.facebook.com/EndlessIndonesia/.
